Pulse Beta Terms and Conditions

These Beta Terms and Conditions (“Beta Terms”) govern the use of Pulse (the “Platform”), the beta innovation review platform operated by INSO Limited, Guernsey Registration Number 75395, of 6 Highclere House, Kings Mews, Kings Road, St Peter Port, GY1 1QB, Guernsey (“INSO”, “we”, “us”, “our”). These Beta Terms supplement and should be read alongside INSO’s Terms of Service, Privacy Policy, and Cookie Policy.

By creating an account, accessing Pulse, creating or distributing Reports, inviting respondents, uploading information, purchasing access, or downloading any output, the organisation and each authorised user agree to these Beta Terms.

1. Definitions

In these Beta Terms:

  • Account means an account created to access and administer the Platform.
  • Administrator means a person authorised by an organisation to manage its Account, create Reports, distribute survey links, manage respondents, and access outputs.
  • Platform means Pulse, the beta innovation review platform operated by INSO (also referred to in these Beta Terms as "Pulse" or "the Platform").
  • Organisation means the legal entity subscribing to or using the Platform.
  • Report means a survey, assessment, or other output created in the Platform, including any related dashboards, summaries, recommendations, scores, internal reports, external reports, or downloadable files.
  • Respondent means any individual who accesses and completes a survey, questionnaire, or assessment through the Platform.
  • Beta Services means Pulse and all related features, outputs, AI-assisted analysis, and services made available by INSO on a beta, pilot, early access, or pre-release basis.
  • Organisation Data means all data, text, prompts, responses, files, survey content, administrative information, respondent submissions, and other material submitted to or generated within the Platform on behalf of an Organisation.

2. Beta service notice

The Platform is provided as a beta product for testing, evaluation, and limited commercial use. It may contain bugs, errors, security weaknesses, incomplete features, unstable functionality, or other defects.

Features may be changed, suspended, limited, removed, or discontinued at any time without notice. No guarantee is made that the Platform will be uninterrupted, available at all times, or compatible with any particular use case.

3. AI use and report generation

The Platform uses artificial intelligence to generate, summarise, structure, interpret, and enhance Reports and related outputs. AI may also be used in connection with external analysis, scraping, or research tools that process publicly available or other external information relevant to the Organisation.

AI-generated content may be incomplete, inaccurate, outdated, misleading, biased, or based on imperfect assumptions. INSO does not guarantee the accuracy, completeness, reliability, suitability, or fitness for purpose of any Report or any part of it.

All Reports are for informational purposes only. The Organisation remains solely responsible for reviewing outputs before relying on them, sharing them, publishing them, or using them for any internal or external decision-making.

4. No sensitive information

Because the Platform is in beta, the Organisation and all users must not upload, submit, or include:

  • sensitive personal data or special category data;
  • commercially sensitive information;
  • trade secrets;
  • confidential legal, financial, HR, or strategic information;
  • passwords, credentials, or access keys;
  • health, biometric, or criminal data; or
  • any information the Organisation is not legally entitled to share.

The Organisation is solely responsible for ensuring that all information entered into the Platform is lawful, appropriate, and suitable for a beta environment. INSO may remove prohibited content, suspend access, or terminate an Account if necessary.

5. Account responsibility

The Organisation must ensure that each Account is created and used by an authorised representative. The Organisation is responsible for keeping Account details accurate and up to date.

The Organisation is responsible for all activity carried out through its Account, including activity by Administrators, employees, contractors, or anyone using the Organisation's login details or survey links.

Administrators are responsible for:

  • creating and configuring Reports;
  • selecting recipients;
  • distributing survey or Report links;
  • managing access and internal circulation; and
  • ensuring the Organisation's use of the Platform complies with applicable law and these Beta Terms.

6. Survey links and respondent access

The sharing, forwarding, circulation, and management of survey links is entirely the responsibility of the Organisation and its Administrators.

INSO does not guarantee that survey links will be blocked from unwanted, unintended, unauthorised, or malicious respondents. INSO does not guarantee that only intended recipients will access or complete a survey.

The Organisation accepts all risk arising from the distribution of survey links, including accidental forwarding, internal misuse, spoofed responses, duplicate submissions, and responses from unintended individuals.

7. Reports, use, and sharing

Subject to payment in full and continued compliance with these Beta Terms, the Organisation may access and use its Reports for its internal business purposes.

The Organisation is responsible for deciding how to share, circulate, present, disclose, publish, or otherwise use the contents of any Report. INSO does not control any downstream use of a Report once it has been accessed or downloaded.

Unless otherwise agreed in writing:

  • the Organisation retains responsibility for Organisation Data;
  • INSO retains all rights in the Platform, software, methodology, workflows, prompts, templates, structure, and underlying intellectual property; and
  • INSO may use anonymised, aggregated, or non-identifying usage information to improve the Platform and related services, in accordance with applicable law and INSO's Privacy Policy.

8. Payment and no refunds

All fees for the Platform are payable in advance unless INSO agrees otherwise in writing.

No Report will be made available for download until payment has been received in full and cleared by INSO.

All payments are non-refundable. This no-refund policy applies regardless of whether the Organisation uses the Platform fully, partially, or not at all; obtains a desired response rate; experiences dissatisfaction with beta functionality; or later decides not to proceed.

9. Deletion and data loss

If any Report, response data, or Organisation Data is deleted by the Organisation, its users, or through Platform functionality, INSO is not obliged to restore, recover, reconstruct, or retrieve it.

The Organisation acknowledges that deleted Reports and underlying data may be permanently lost. The Organisation is solely responsible for backing up, exporting, and retaining any material it wishes to keep.

10. Privacy and data protection

The Organisation is responsible for ensuring that it has a valid legal basis for collecting, uploading, and using personal data through the Platform, including employee and respondent data where applicable.

The Organisation must provide any notices, obtain any consents, and complete any internal approvals required under applicable data protection, employment, and workplace laws.

INSO's Privacy Policy explains how INSO handles personal information in connection with its services and sets out INSO's general privacy approach.

11. Security and availability

INSO may use reasonable security measures for the Platform, but no online system is completely secure. The Organisation accepts the residual risks associated with internet-based and beta services, including unauthorised access, delay, corruption, loss, or accidental disclosure.

INSO does not guarantee any minimum uptime, support response time, storage duration, or error correction timeline. Beta features may be interrupted, rate-limited, modified, or withdrawn at any time.

12. Acceptable use

The Organisation and all users must use the Platform lawfully and responsibly, consistent with INSO's existing Terms of Service and all applicable laws.

Users must not:

  • upload unlawful, infringing, defamatory, offensive, or misleading material;
  • interfere with the Platform or attempt to bypass security;
  • use automated means to extract or replicate the Platform except where expressly permitted;
  • impersonate others or misrepresent respondent identity;
  • share credentials improperly; or
  • use the Platform in breach of confidentiality, employment, or regulatory obligations.

INSO may suspend or terminate access if it reasonably believes this section has been breached.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Platform and Beta Services are provided on an as is and as available basis, without warranties of any kind, whether express, implied, statutory, or otherwise.

INSO disclaims all warranties relating to accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, uninterrupted access, security, performance, and compatibility with the Organisation's needs.

14. Limitation of liability

To the fullest extent permitted by law, INSO will not be liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profits, revenue, goodwill, business opportunity, reputation, data, or use arising from or connected with the Platform, any Report, or these Beta Terms.

INSO will also not be liable for:

  • inaccuracies in AI-generated outputs;
  • deleted or unrecoverable Reports or data;
  • unintended respondent access;
  • survey links being forwarded or accessed by unwanted respondents;
  • service interruptions, bugs, or beta instability; or
  • decisions made by the Organisation or any third party based on any output.

To the extent liability cannot be excluded, INSO's total aggregate liability for any claim arising from the Platform shall not exceed the amount paid by the Organisation to INSO for the relevant service in the 3 months preceding the event, or £500, whichever is lower.

15. Indemnity

The Organisation shall indemnify and hold harmless INSO, its officers, directors, employees, contractors, affiliates, and licensors against all claims, liabilities, losses, damages, costs, and expenses arising from:

  • the Organisation's use of the Platform;
  • breach of these Beta Terms;
  • unlawful, inaccurate, or unauthorised Organisation Data;
  • misuse of survey links;
  • breach of data protection, employment, confidentiality, or regulatory obligations; or
  • the Organisation's sharing, publication, or reliance on any Report.

16. Suspension and termination

INSO may suspend, restrict, or terminate access to the Platform immediately if:

  • fees are unpaid;
  • these Beta Terms are breached;
  • there is suspected misuse, unlawful conduct, or security risk;
  • continued access may expose INSO to legal, operational, or reputational harm; or
  • INSO decides to discontinue the beta offering.

On termination, access to the Platform and associated Reports may cease immediately.

17. Changes to these terms

INSO may update these Beta Terms from time to time to reflect changes in the Platform, legal requirements, or business operations. Continued use of the Platform after updated terms take effect constitutes acceptance of the revised terms.

18. Governing law

These Beta Terms, and any dispute or claim arising out of or in connection with them, the Platform, or any Report, are governed by the laws of Guernsey, and the courts of Guernsey have exclusive jurisdiction, except where mandatory law requires otherwise.
